Collection and Use of Information about Customers

We are the sole owner of the information collected on our sites. When you complete an online quote request or purchase, we collect your name, shipping and billing addresses, telephone number, credit card number and email address (optional) so that we can process your request for quotation or your order and ensure that the information or the product(s) is delivered to the correct address. We ask for your email address so that we can send you emails following a purchase that confirms your purchase and provides an order summary with your order number and a tracking number so that you can determine the status of your order. We ask for your phone number so that we may contact you if there are any problems with your order or shipping.

Why we need an email address during check out

The email address you provide during checkout is only used to send you an email confirmation with your order details, along with an email containing tracking information once your order has shipped. In some cases, we will email a customer if there is a problem with their order (e.g., problem with credit card, item suddenly becomes back-ordered, etc.).

Secure Check Out and Credit Card Protection

Our servers are hosted within a secure hosting facility, behind an up-to-date firewall and monitored by intrusion detection systems. The checkout and confirmation areas of our site are secured using SSL (Secure Sockets Layer) technology, ensuring that your credit card number and personal data are never sent over the Internet without encryption.

Your credit card information is stored on a secured server that is not connected to the Internet. Statistically, using your credit card to make purchases on our site is more secure than using it in a department store.

Your full credit card number is never displayed on our site--just select numbers. This prevents someone from seeing your card number on your monitor.

Bowhead Lifetime Limited Warranty

Bowhead will repair or replace, at its discretion, any Bowhead part it determines to be defective for as long as the original registered owner owns the e-cycle.

All Original Equipment Manufactured (OEM) third-party components integrated into the Bowhead e-cycle solution are covered under the OEM’s warranty only.

Surface finish, original components, and all Bowhead branded parts or components, replacement parts, and accessories are warranted to be free from manufacturing defects in material or workmanship for a period of one (1) year from the original date of purchase (the "Warranty Period").

Limitations:

• Normal wear and tear, claimed defects, and malfunctions or failures that result from abuse, neglect, improper assembly, improper maintenance, alteration, collision, crash, or misuse are excluded from warranty coverage. The owner is responsible for all labor charges.

• Only the original owner is covered by this Limited Warranty.

• Consumables or normal wear and tear parts (Including tires, tubes, brake pads, cables and housing, grips, chain, and spokes.

• Any damage or defects to Covered Components resulting from failure to follow instructions in the e-cycle user manual, accident, misuse, neglect, abuse, commercial use, alterations, modification, improper assembly, installation of parts or accessories not originally intended or compatible with the e-cycle as sold, operator error, water damage, extreme riding, stunt riding, or improper follow-up maintenance.

• Bowhead will not be liable and/or responsible for any damage, failure or loss caused by any unauthorized service or use of unauthorized parts or components.

• Bowhead may ask that products being replaced under warranty are either returned to Bowhead or destroyed.

• If product is to be destroyed, Bowhead’s Warranty Department will instruct the customer to destroy product and send photo documentation before shipping replacement.

• If the product needs to be returned to Bowhead, the customer is responsible for the cost of shipping products, freight prepaid, and insured. Bowhead assumes no responsibility for products during shipment from the customer to our Warranty Department. Shipping charges are nonrefundable.

Bowhead Design Corporation Sale, Waiver and Release from Liability Agreement

Bowhead Design Corporation (“Bowhead”) sells the Bowhead Reach ™ , Bowhead RX ™, and Bowhead Rogue ™ Adventure-E bikes, and/or other bike components and accessories to purchasers. Purchaser(s) take delivery of the Bowhead bike(s) directly, or on behalf of a stipulated, engaged third-party.

Bowhead and the Purchaser(s) shall be referred to hereafter as “the Parties.” This Waiver and Release from Liability consummates the extent of the relationship between Bowhead and the Purchaser(s), and shall be referred to hereafter as the “Contract”, and is in effect upon formal acceptance of the quote, or receipt of partial of full payment, or upon possession of the bike as taken by, or on behalf, of Purchaser.

Purchaser(s) agrees and understands that Bowhead cannot oversee or supervise the safety and proper usage of Purchaser’s Bowhead bike and components and/or accessories. Consequently, Bowhead cannot be held responsible for the safe use or other actions by the Purchaser and/or future riders of Bowhead bikes.

Purchaser, being older than 16 years of age, and having made purchase of the Bowhead electric bike, agrees to all terms as follows:

Agrees and acknowledges that no one, including purchaser, should ride an electric bike while under the influence of alcohol or drugs, including prescription medications, or while otherwise incapacitated.

Agrees and acknowledges that no one, including purchaser, should ride an electric bike without an industry approved helmet.

Agrees and acknowledges that it is not safe to ride Bowhead electric bikes in hazardous conditions, including uneven or off-road terrain, significant rain or in snow, and assumes all risks of riding the Bowhead electric bikes under these and/or any other unsafe conditions. Understands that jumping the bike is dangerous and not an action intended for the bike. When riding the Bowhead electric bike, purchase agrees to obey any and all federal electric bike laws and regulations, and all other state, provincial, county, municipal and city laws, including electric bike laws.

Purchaser acknowledges and understands that riding a Bowhead electric bike is a dangerous activity that requires moderate to strenuous exercise and various degrees of skill and experience for individual riders. Understands that biking can result in serious injury to the person and damages to property.

Voluntarily assumes any and all risk associated with loss, damage or physical injury that occurs while riding the Bowhead electric bike.

Purchaser is aware of the risks, hazards and dangers of personal injury, death and disability inherent in the use of electric bikes, including Bowhead bikes.

Is aware that the usual risks, hazards and dangers of personal injury, disability and death are greater with lack of experience and/or failure to follow the warnings and instructions, including maintenance suggestions, provided by Bowhead directly and/or by information in its Operator’s Manual, and within the manuals accompanying the various components of the Bowhead bike, access to which have been provided by Bowhead.

Hereby agrees to release and forever discharge Bowhead, and its agents, employees, officers, directors, component manufacturers, resellers, affiliates, and any and all other persons or entities acting on Bowhead’s behalf from any and all legal claims, actions, damages, liability, costs, expenses or attorney fees related to, arising out of, or in any way connected to use of the Bowhead bikes, use of any other equipment or property supplied by Bowhead, or from any claim arising out of my presence, upon the Bowhead premises, whether or not such claims, actions, damages, liability, cost or expenses are caused by the negligence of Bowhead, including its agents, employees, officers, directors, component manufacturers and/or any and all other persons or entities acting on Bowhead’s behalf. By completing the purchase transaction this quote represents, you surrender and waive any and all rights to sue or to exercise a legal right to seek damages from Bowhead, and/or its agents, employees, officers, directors, component manufacturers, resellers, affiliates, and any and all other persons or entities acting on Bowhead’s behalf.

You have carefully read the foregoing and acknowledge, understand and AGREE to all of the above terms and conditions. You have had the opportunity to ask any and all questions regarding this Contract. By signing this quote and issuing payment for the Bowhead electric bike you assume all risks inherent in the purchase and use of an electric bike, and release Bowhead from any and all liability that may arise from my ownership and use of the Bowhead bike. This includes a release of Bowhead from any and all liability related to or arising out of a minor’s use of the Bowhead bike.

Binding Arbitration Clause: The Parties agree that any dispute, controversy or claim arising out of or relating to this Contract or as a result of the use of a Bowhead bike and accessories; including warranty claims, defective product claims, physical injury claims, property damage claims and/or whether any of the aforementioned claims are arbitrable, will be referred to and finally determined by arbitration in accordance with the Judicial Arbitration and Mediation Services (“JAMS “) International Arbitration Rules. The tribunal will consist of a sole arbitrator. Judgment upon the award rendered by the arbitrator may be entered by any court having jurisdiction thereof. In the event a party fails to proceed with arbitration as delineated in this paragraph, unsuccessfully challenges the arbitrator’s award, or fails to comply with arbitrator’s award, the other party is entitled to costs of suit including reasonable attorneys’ fees for having to compel arbitration or defend or enforce an award.

Nano Travel Chair – Limited Warranty Policy Thank you for choosing the Nano Travel Chair. We stand behind the quality of our products and are committed to supporting you. Please review the warranty details below.

1. Limited Warranty Coverage

The Nano Travel Chair is covered by a Limited Warranty against defects in materials and workmanship under normal use.

Warranty Period

• Frame: 3 Years from the date of original purchase

• Structural Components: 3 Years from the date of original purchase

• Wear Components (tires, upholstery, bearings, cushion, straps, etc.): 90 Days from the date of original purchase Warranty coverage applies only to the original purchaser and is non-transferable.

Coverage – Other

All Original Equipment Manufacturer (OEM) third-party components integrated into the Nano Travel Chair solution are covered under the applicable OEM manufacturer’s warranty only.

Shipping & Returns for Warranty Review

Do not return products to Bowhead without Bowhead’s prior written consent.

Returns must be shipped freight pre-paid. Bowhead recommends that you insure the product for its full replacement cost when shipping.

Bowhead may request that specific components — or in certain cases the full Nano Travel Chair — be returned for inspection prior to approving warranty replacement.

Limitations

The following are excluded from warranty coverage:

• Normal wear and tear.

• Claimed defects, malfunctions, or failures resulting from abuse, neglect, improper use, improper assembly, improper maintenance, alteration, accident, misuse, or improper storage.

• Damage or defects resulting from modification or installation of parts or accessories not compatible with the Nano Travel Chair as sold.

• Operator error, extreme use, commercial or rental use, or improper follow-up maintenance.

• Damage resulting from airline handling, airport transport, baggage systems, freight carriers, or other third-party transportation providers.

• Excludes any labor, insurance, restocking, duty, brokerage, or shipping charges incurred in replacement part installation or repair of the product, unless specifically authorized in writing by Bowhead.

• Only the original owner is covered by this Warranty; coverage is non-transferable.

• Consumables or normal wear items (including tires, bearings, upholstery, straps, seat cushions, protective finishes, and travel bags).

• Bowhead will not be liable and/or responsible for any damage, failure, or loss caused by unauthorized service, disassembly, or use of unauthorized parts or components.

Other Terms

• Unless otherwise provided, the sole remedy under the above warranty, or any implied warranty, is limited to the repair or replacement of defective parts with those of equal or greater value at the sole discretion of Bowhead.

• Bowhead is not responsible for direct, incidental, or consequential damages, including, without limitation, damages for personal injury, property damage, travel disruption, loss of use, or economic losses.

• This Limited Warranty gives you specific legal rights. You may also have other rights which vary by province, state, or country. This warranty does not limit rights that may apply under applicable consumer protection legislation.

How to Obtain Warranty Service

To access warranty services, a Return Authorization Number (“RAN”) must be obtained by the original purchaser from Bowhead Corp.

The original purchaser must contact a Bowhead representative to discuss the issue with the Nano Travel Chair and to obtain a RAN prior to shipping any product. You will also be required to provide:

• Proof of purchase (original receipt or invoice).

• A description of the defect, including relevant images or video of the issue.

• Your name, address, and telephone number. Bowhead will not replace any covered component under this Warranty without first reviewing images or video of the claimed defect.

Warranty Policy Updates

The manufacturer reserves the right to make ongoing updates and modifications to this warranty policy as needed. Any updates to the warranty will be communicated through o[icial channels and may reflect changes in product design, materials, or performance enhancements.

Updates will not a[ect the terms of coverage for products purchased prior to the e[ective date of the changes, unless explicitly stated.
